Sex Crimes

The client, a college sophomore, took the stand and admitted having intercourse with a young girl. The defense relied on the client’s inability to form the necessary mental state to be guilty of molestation because he was half-asleep when the act occurred.

Client, a college student, was accused of raping a girl at a party. After the accusation was made, police contacted the client and demanded that he submit to DNA testing. Due to quick intervention by the defense, the client’s rights were protected and he was able to explain his side of the story without incriminating himself. The case was considered by the prosecution’s office but due to the defense’s diligent advocacy, charges were never filed.

Client was accused, by the mother of his child, of vicious acts of violence. The accuser was married to another man and sought sole custody of the child but the client fought her tooth and nail for six years. Thorough preparation, speedy investigation, and an exceptional team of experts, resulted in the case being dismissed at the preliminary hearing. The client was released after serving three months in jail in solitary confinement.

This case was extraordinarily challenging. The client was a stay at home dad with everything to lose. After diligent preparation by the defense, and aggressive cross-examination of the alleged victim, the jury was able to see the web of lies which the alleged victim had weaved in order to accuse the client.

Outstanding Result: All charges were dismissed upon successful completion of 20 anger management classes
Charges: Domestic Violence
Possible Punishment: 1 year in county jail, 1 year domestic violence program, stay-away orders.
Outstanding Result: Jury verdict of not guilty
Client was accused of hitting, and throwing the mother of his child. She showed the jury photos of bruises all over her body. Due to careful, well- calculated jury selection, the defense was able to convince the jurors that show the bruises were inconsistent with the accuser’s allegations, and that her story was not credible.
Drug Crimes
Charges: Felony Transportation and Sales, and Possession with Intent to Sell Marijuana.
Possible Punishment: 7 years in prison
Outstanding Result: All charges dismissed
As a result of tedious and relentless advocacy, the prosecution dismissed the felony charges and the client pleaded guilty to 1 misdemeanor violation of possession of marijuana. He received a $300 fine with no jail and no probation.
Charges: Felony Possession with Intent to Sell, Transportation, and Sales of Cocaine
Potential Punishment: 7 years in prison
Outstanding Result: Client received Prop 36 treatment and all charges were dismissed form his record upon successful completion
The client was ineligible for Prop 36 treatment based on the charges but the Court was persuaded through zealous advocacy to make a “personal use” finding which enabled the client to enter into Prop 36 treatment.
Charges: Possession of Methamphetamine
Potential Punishment: 3 years in prison
Outstanding Result: Charge dismissed
Client entered into a deferred entry of judgment (DEJ) program and all charges were dismissed upon successful completion.
DUI
Charges: DUI – First Offense
Potential Punishment: 6 months in jail and license suspension
Outstanding Result: All DUI and alcohol-related charges were dismissed in exchange for an exhibition of speed charge. The court and the DMV did not suspend the client’s driver’s license
Charges: DUI – Refusal
Potential Punishment: Minimum of 96 hours in jail, up to 1 year in jail, and a 9-month alcohol program
Outstanding Result: Probation, no jail, and a 3-month alcohol program
Charges: Felony DUI – Multiple offenses and accident with injury
Possible Punishment: 4 years prison, mandatory alcohol programs, fines, fees, license suspension
Outstanding Result: Client received credit for time served
This was an extraordinary result given the facts of the case. The client had 10 prior convictions for DUI over the past fifteen years. In this particular case, he caused an accident resulting in serious injury to the other driver. The prosecution was relentless and unforgiving. The defense pled open to the court and convinced the Judge to release the client immediately and allow him to enter into a 6-month inpatient alcohol program in lieu of any jail or prison time.
Charges: Boating under the Influence, and Manslaughter – 2 counts

Outstanding Result: Client received probation and no jail or prison time
Charges: DUI – Excessive BAC .18 and Accident
Possible Punishment: 6 months jail, license suspension, mandatory alcohol programs, fines, fees, license suspension
Outstanding Result: Case dismissed
The prosecution’s case had numerous weaknesses which the defense exposed at every step. On the first day of trial, the prosecutor dismissed the entire case.

Charges: DUI – Under 21 (zero tolerance)

Outstanding Result: All DUI charges dismissed
Despite the clients high BAC, the defense successfully negotiated a deal that would allow the client to keep her license and not have these charges on her records. The client pled no contest to excessive speeding and agreed to take the alcohol program. Her license was not suspended.
Federal Crimes
Charge: Fraud and Conspiracy

Outstanding Result: 1 year of probation and no prison time.
Charges: Felon in Possession of a Firearm
Potential Punishment: 10 years in prison
Outstanding Result: Case was dismissed after a successful motion to suppress evidence
Charges: Possession and Distribution of Child Pornography
Potential Punishment: Life in prison
Outstanding Result: 52 months in prison
This was an exceptional result under the facts of the case and because the law required that the client serve a mandatory minimum sentence of at least 10 years in prison.
Charges: Conspiracy and Drug Trafficking of Marijuana
Possible Punishment: Life in prison
Outstanding Result: Client received 45 months in prison and was released early into a halfway house
This was a particularly outstanding result given that the client had suffered over 10 prior convictions for drug sales in the past and was facing a mandatory minimum of 10 years in prison.
Charges: Unlawful Possession of a Firearm
Possible Punishment: 10 years in prison

Charges: Fraud and Money Laundering

This was a particularly great result because client was also on probation for a theft offense at the time of this alleged offense.
Charges: Fraud, Burglary, and Receiving Stolen Property

The defense was able to convince the prosecution that the real problem in this case was drug addiction. The prosecutor agreed to dismiss all charges in exchange for the client’s completion of drug counseling.
