Domestic Violence Defense Attorney Los Angeles

Criminal Defense Attorneys, Los Angeles

Los AngelesDomestic Violence is a serious crime in California. Accusations of domestic violence often have numerous devastating consequences both in and out of the courtroom. You will need an experienced and skilled criminal defense lawyer who has the compassion and empathy necessary to aggressively fight for you and to help you through this difficult time. At White Goldstein, we specialize in all domestic violence and domestic abuse cases.

Domestic violence often exists in spousal relationships, dating relationships, among cohabiters (people living together), divorced or separated couples, between family members, or among children. Common domestic violence crimes include: assault, battery, criminal or terrorist threats, attempted murder, stalking, harassment, child abuse, and child endangerment.

The accuser cannot simply “make the charge go away.” Once an accusation is made, the law enforcement agency and the prosecutor working on your case are in complete control. It is not uncommon in domestic violence cases for the accuser to “take back” what he or she previously said and/or to insist that the prosecutor should not proceed with the charges. Even if the accuser claims to have lied to the police, it is within the sole discretion of the prosecutor to decide whether the charges are justified and whether there is sufficient evidence to pursue the case.

As female criminal defense attorneys, we use a unique combination of experience, knowledge, compassion, dedication and drive, to tenaciously fight for, and defend, our clients. There are many benefits to having women lawyers represent you in a domestic violence case. A female criminal defense lawyer who can show the jury that she believes in her client, by defending him or her with both passion and compassion, will have a better chance at persuading the jury that you – that client– are innocent.

In our society it is more acceptable for a woman to show her feelings than a man. Therefore, a woman criminal defense attorney will make a more significant psychological impact on the jury because in our society it is acceptable for her to argue with both her intellect and her emotion. This strategy is especially effective when we represent male clients against female accusers. Furthermore, jurors are more accepting of a female attorney who aggressively cross-examines a female or child accuser; whereas a male attorney who uses the same harsh cross-examination strategy may be negatively perceived as attacking the alleged victim or “picking on” him or her.

Many domestic violence offenses can be charged as either a misdemeanor or a felony. If convicted of a misdemeanor, it is possible for you to receive probation and/or anger management classes. The maximum sentence a defendant can receive for a misdemeanor conviction is one year in the county jail. If you have been accused of a more serious act of domestic violence, for example, one that involves visible physical injuries, threats to kill or injure the victim, or another serious form of abuse, it is likely that you will face felony charges. If you have been convicted of a domestic violence felony, then it is possible to be sentenced to probation. However, it is likely that you will face time in county jail or prison.
